B-BBEE is defined by government as: “an integrated and coherent socio-economic process that directly contributes to the economic transformation of South Africa and brings about significant increases in the number of black people that manage, own and control the country’s economy as well as significant decreases in income inequalities.”

To put it simply – B-BBEE need to encourage a change and transformation in the South African economic landscape enabling access of black south africans.

In legal terms, ‘black people’ according to the BEE Act is “a generic term which means Africans, Coloured and Indians, including only natural persons who are citizens of the Republic of South Africa by birth or descent; or are citizens of the Republic of South Africa by naturalization:

a) Occurring before the commencement date of the Constitution of the Republic of South Africa Act of 1993; or

b) Occurring after the commencement date of the Constitution of the Republic of South Africa Act of 1993; but who, without the Apartheid policy would have qualified for naturalization before then.”

The Government now also added second-generation South African Chinese to this definition.
